These terms apply to orders placed on magicgift.ro. You expressly accept them when you place an order.
We sell personalised artworks configured online by the customer: star map, moon phase, map of a place, zodiac sign, song and music player, solar system, artworks with the customer's photo and text, as well as the artwork with a built-in speaker. Depending on the product, the artwork is delivered framed, on canvas or as a poster, in the sizes shown on the product page.
Each product is made to order, based on the configuration, photo and text provided by the customer. The preview on the page shows the composition of the artwork; there may be slight colour differences between the screen and the printed material.
The display of products on the website is an invitation to place an order. The contract is concluded when you receive the order confirmation by email. The contract is concluded in Romanian (or in the language of the website version used). The confirmation email contains the order details and serves as the record of the contract: you can keep and print it.
We may refuse or cancel an order, with a full refund of the amounts paid, if the details are manifestly incorrect or if the personalisation infringes the rights of others (section 8).
Prices are shown in lei (RON) for Romania and in the currency of the chosen country for other countries, and are final prices. TOP GUIDE S.R.L. is not registered for VAT purposes, so no VAT is added to the prices. For Romania, only shipping of 19 RON is added, shown in the cart before you place the order. For other countries, shipping is included in the price.
Payment methods: cash on delivery to the courier (Romania only, cash or card where available) and online card payment, via Netopia Payments (Romania) or Stripe (international). Card details are entered directly with the payment processor; we do not see or store them.
Your order leaves our workshop within 24 hours, and shipping takes 1–3 working days in Romania and 5–10 working days to other countries (2–4 and 6–11 working days in total, respectively). For Romania, working days are Monday to Friday; for other countries, Monday to Saturday. Details in the Shipping Policy.
You can return any product, including personalised ones, within 14 calendar days of delivery, without giving a reason. Although Romanian Government Emergency Ordinance – OUG no. 34/2014, Art. 16(c); Directive 2011/83/EU, Art. 16(c) would allow us to exclude personalised products, we have chosen to offer the right of return for all orders. The product is returned in new condition, by courier, with the return label we send you; the actual cost of return shipping is borne by you, except for damaged, defective or incorrect products, for which the return is free of charge. All products, including personalised ones, benefit from the 2-year legal guarantee of conformity from delivery, in accordance with OUG no. 140/2021. If the product arrives damaged, defective or different from the order, we remake it free of charge or refund your money in full, in accordance with the Return Policy.
When you upload a photo or text, you confirm that you have the right to use them: you are their author or you have the consent of the author and of the people who appear in the photo. We do not make products that reproduce protected works without proof of a licence (for example characters, logos, trademarks or works of art). We may refuse such orders, with a full refund. We use the photos only to fulfil your order, in accordance with the Privacy Policy.
For the song prints, the lyrics can be filled in automatically from a public lyrics database (LRCLIB), based on the artist and title you choose, or you can write or edit them yourself before ordering. The print is made as a single copy, to your order and for your personal use. By choosing the lyrics of a song, you take responsibility for their use. The rights to the songs and lyrics belong to their authors and publishers; magicgift.ro is not affiliated with the artists or record labels.
Personal data is processed in accordance with the Privacy Policy and Regulation (EU) 2016/679 (GDPR). Cookies are described in the Cookie Policy.
The contract is governed by Romanian law, including Law no. 365/2002 on electronic commerce and OUG no. 34/2014, without depriving you of the protection afforded to you by the mandatory provisions of the country in which you live. We first try to resolve any problem amicably. You can contact the Romanian National Authority for Consumer Protection – ANPC (anpc.ro), the alternative dispute resolution procedure (anpc.ro/ce-este-sal) or consult the European information on consumer disputes (consumer-redress.ec.europa.eu).
